EFAD welcomes European Parliament report on Copyright and Generative Artificial Intelligence
On 10 March, the European Parliament adopted in plenary the Legal Affairs Committee Report “Copyright and Generative Artificial Intelligence”, led by rapporteur Axel Voss, highlighting the need to ensure transparency, remuneration and effective safeguards for rightsholders.
The European Film Agency Directors Association (EFAD) welcomes the adoption of the resolution and its recognition of the importance of protecting European creative works in the context of rapidly developing AI technologies.
In particular, the European Parliament highlights:
- Transparency obligations, requiring AI providers and deployers to disclose all copyrighted works used to train generative AI systems;
- Fair remuneration for rightsholders, recognising the economic importance of the European creative sectors and the need to ensure that the use of copyrighted material by AI systems is compensated in a proportionate manner;
- The development of licensing mechanisms, including voluntary collective licensing per sector, to restore the bargaining power od rightholders and facilitate lawful access to protected works for AI training purposes;
The possibility for rightsholders to exclude their works from AI training, including through a potential opt-out mechanism that could be managed by the European Union Intellectual Property Office (EUIPO);
EFAD supports the European Parliament’s call for clear rules ensuring transparency, respect for copyright and fair remuneration for creators and rightsholders, and looks forward to continued engagement with the European Commission and EU co-legislators on the development of a balanced framework for artificial intelligence that ensures the sustainability of Europe’s cultural and creative ecosystem while enabling creative innovation.
